Your privacy is important to us at Nonco LLC, Delaware registered number 7316835, Nonco (BVI) Limited registered number 2102338; owned by Metatech Holdings (“we”, “us”, “our”, “Nonco Group” and “Nonco”), we take each individuals’ privacy seriously.

The following Privacy Policy is served in connection with your dealings with, and provision of Personal Data or information (“Personal Data”) to us and/or our affiliates. For the purpose of this Privacy Policy, any “member of Nonco Group” shall mean Nonco LLC, Nonco (BVI) Limited or any of its affiliates, subsidiaries, holding companies, associated entities and any of their branches and offices, wherever situated. The rights and obligations of each of the members of Nonco Group under this Privacy Policy are several and not joint. No member of Nonco Group shall be liable for any act or omission by the other.

We are committed to protecting the privacy interests of those who provide us with information about themselves. Your Personal Data will not be sold, exchanged, transferred, or disclosed to any other parties for any reasons whatsoever without prescribed consent, other than for the Purposes (as hereinafter defined) expressed below.

All members of Nonco Group, our employees and third parties, including our Sub-Processors (as hereinafter defined) are bound by contract to uphold the standards of privacy, confidentiality and security.

Nonco Group will comply with the applicable data protection and privacy legislation in the jurisdictions where we operate (the “Data Protection Legislation”) and any personal data received by Nonco Group in the course of performing any of the services offered by Nonco Group will be processed in accordance with the Data Protection Legislation and Nonco’s policies and procedures. Nonco Group shall ensure that it has in place appropriate technical or organizational measures to protect against unauthorized or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data, appropriate to the harm that might result from the unauthorized or unlawful processing or accidental loss, destruction or damage and the nature of the data to be protected, having regard to the state of technological development and the cost of implementing any measures.

When do we collect Personal Data?

We will be collecting Personal Data from you in connection with the Purposes (as hereinafter defined). We may collect Personal Data from you in various circumstances including but not limited to when you apply to register a user account with us; order products or services from us; subscribe to our newsletter; complete any application form to us or submit any query or request to us. In some cases, we may be required by law to collect certain types of information about you. The information will generally be collected from you directly, but sometimes we may obtain information through a third party, such as representatives, agents or contractors who provide services to us, or third parties acting on your behalf or from other sources, as the case may be.

What Personal Data do we collect?

financial status details, such as credit card, bank account or other payment details; blockchain identifiers, such as blockchain addresses and public keys; usernames and passwords that you create when registering for an account with us; and records of our communications with you, including any messages you send us.

Failure to supply any Personal Data may result in us or Nonco Group being unable to provide you with our products or services (or with all of the features and functionality offered by our products or services), to respond to queries or requests that you submit to us or to comply with any laws, regulations, guidelines and codes issued by regulatory or other authorities.

You may, however, visit our website at www.nonco.com (“Nonco Site”) anonymously.

What do we use the Personal Data for?

We collect your information to enable us to provide the requested services to you and for improving service, customer support, and browsing experiences for our site visitors. We will indicate clearly on relevant forms and applications as to whether the information is mandatory or voluntary. Should the information be mandatory, you must submit valid personal information in order to complete the application to respective services. Without such information, we will not be able to undertake the service.

The Personal Data we collect may be used in any one of the following purposes (“Purposes”):

  • to administer the products and services we deliver, including developing new ways or products; to meet your needs and grow our business, and processing transactions;

    • any present or future contractual or other commitment with local or foreign legal, regulatory, judicial, administrative, public or law enforcement body, or governmental, tax, revenue, monetary, securities or futures exchange, court, central bank or other authorities, or self-regulatory or industry bodies or associations of financial service providers or any of their agents with jurisdiction over all or any part of Nonco Group (together the “Authorities” and each an “Authority”) that is assumed by, imposed on or applicable to us or any member of Nonco Group; or
    • any agreement or treaty between the Authorities;
  • to comply with any obligations, requirements, policies, procedures, measures or arrangements for sharing Personal Data and information within Nonco Group and/or any other use of Personal Data and information in accordance with any programmes for compliance with sanctions or prevention or detection of money laundering, terrorist financing or other unlawful activities;
  • to conduct any action to meet our obligations or those of any member of Nonco Group to comply with laws or international guidance or regulatory requests relating to or in connection with the detection, investigation and prevention of money laundering, terrorist financing, bribery, corruption, tax evasion, fraud, evasion of economic or trade sanctions and/or any acts or attempts to circumvent or violate any laws relating to these matters;
  • to meet our obligations or those of any member of Nonco Group to comply with any demand or request from the Authorities;
  • to enable actual or proposed assignee(s), or participant(s) or sub-participant(s) of our rights in respect of you to evaluate the transaction intended to be the subject of assignment, participation or sub-participation and enabling the actual assignee(s) to use your Personal Data in the operation of the business or rights assigned; and
  • any other purposes relating to or incidental to any of the above.

In addition, we may also collect, use and disclose your Personal Data for the following purposes (which we shall describe in our documents and agreements as “Additional Purposes” for the handling of Personal Data):

  • providing or marketing services, products and benefits to you, including promotions, loyalty and reward programmes;
  • matching Personal Data with other data collected for other purposes and from other sources (including third parties) in connection with the provision or offering of products and services, whether by us or other third parties;
  • sending you details of products, services, special offers and rewards, investment or research reports or guides, either to our customers generally, or which we have identified may be of interest to you; and/or
  • conducting market research, understanding and analyzing customer behavior, location, preferences and demographics for us to offer you products and services as well as special offers and marketing programmes which may be relevant to your preference and profile.

When will the Personal Data be disclosed?

Personal Data held by us or a member of Nonco Group will be kept confidential but we or a member of Nonco Group may provide Personal Data to the following parties or any of them (whether within or outside of BVI or the United States) for the Purposes listed above:

  • any member of Nonco Group;
  • any agents, contractors, sub-contractors or associates of Nonco Group, including their employees, officers, agents, contractors, service providers and professional advisers that we or any member of Nonco Group engage(s) in connection with the operation or maintenance of our business and services (e.g. back office processing, individual and corporate Know-Your-Client processing) (“Sub-Processors”);
  • any Authorities;
  • any persons under a duty of confidentiality to us or a member of Nonco Group which have undertaken to keep such Personal Data confidential;
  • any persons acting on your behalf whose Personal Data are provided, including but not limited to authorized representatives or nominees;
  • any persons to whom we are or any member of the Nonco Group is under an obligation or required or expected to make disclosure by operation of law;
  • any actual or proposed assignee(s) of ours;
  • any actual or proposed participant(s), sub-participant(s) or transferee(s) of our rights in respect of you;
  • any person(s) in whose favor of our obligations with respect to you are, or are intended to be a subject of any assignment, participation, sub-participation, transfer, novation or other similar arrangement; and
  • any other person(s) directly related to the Purpose.

For the purpose of this section, please note that a party (or parties) mentioned above may have places of business outside of the United States. Your Personal Data may be provided or transferred out of the United States as a result. Customers based in the European Union (EU) accept that to fulfill our services we will transfer your Personal Data outside the EU, and explicitly consent to such transfer. These parties adhere to their own privacy customs and policies which we have no control over and may be subject to a lower level of protection. Consequently, your Personal Data may cease to be protected by any relevant confidentiality or Personal Data protection laws of the United States.

Security of Personal Data

We implement a variety of security measures to maintain the safety of the Personal Data when you place an order or enter, submit, or access your personal information. We offer the use of a secure server. All supplied sensitive information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Personal Database to be accessed only by those authorized with special access rights to our systems, and are required to keep the information confidential.

More generally, we will develop, implement and maintain safeguards appropriate to our size, scope and business, our available resources, the amount of Personal Data that we hold and identified risks (including use of encryption and pseudonymisation where applicable). We will regularly evaluate and test the effectiveness of those safeguards to ensure security of our processing of the Personal Data.

Do we use cookies?

Yes. Retention of Personal Data

The Personal Data collected will not be retained any longer than is necessary for the fulfillment of the Purposes. We shall securely delete or destroy Personal Data retained at the end of such period, and require our Sub-Processors to do likewise.

Personal Data Access and Correction

Relevant privacy laws and regulations permit you to request us to correct and provide you with access to the Personal Data. We shall honor such requests, although we reserve the right to charge a reasonable fee.

Individuals in the EU also have the right to lodge a complaint about the processing of their Personal Data with their local Personal Data protection authority.
